Mediation
Two or more parties seek peaceful resolution through the services of a BDR mediator. Mediation is confidential and aids discussion among the parties with the objective of reaching a resolution all can accept. It typically takes place with attorneys and their clients in attendance. At all times in a mediation, the parties retain control of responsible decision making. Pre-session preparation is a mainstay of the BDR approach.
Arbitration
A private method for resolving disputes outside the courtroom. BDR provides professional arbitrators. Arbitration may use rules of evidence and procedure that are less formal than those followed in trial courts, which usually leads to a faster, less-expensive resolution. There are many types of arbitration in common use. Binding arbitration is similar to a court proceeding in that the arbitrator has the power to impose a decision. In non-binding arbitration, the arbitrator can render a decision that is merely advisory.
Neutral Fact-Finding
Investigative services provided by BDR to establish the facts of a case, usually when legal action is threatened. Some factual questions can be answered with full certainty; with others, uncertainty cannot be totally expunged and so must be minimized. Disputes must then be resolved despite incomplete data. BDR presents impartial reports to disputants that summarize known facts and the probable range of legal outcomes, and suggest resolution strategies.
